Buried in the Copilot terms of use, last updated on October 24, 2025, sits a line that would make any enterprise buyer pause: "Copilot is for entertainment purposes only. It can make mistakes, and it may not work as intended. Don't rely on Copilot for important advice. Use Copilot at your own risk." The disclaimer isn't new, but a recent wave of attention on Hacker News and tech forums has pulled it into the spotlight, and for good reason. Microsoft spent the last two years welding Copilot into Windows 11, Office, and the $30-per-user-per-month Microsoft 365 Copilot suite. The legal team, apparently, didn't get the memo from marketing.
What the terms actually cover
The "entertainment purposes only" language applies to Copilot for Individuals, which includes the standalone Copilot apps, the website, and (this is the part people miss) conversations with Copilot through other Microsoft apps and websites. It does not apply to Microsoft 365 Copilot, which has its own separate set of terms. But the consumer-facing product is the one baked into Windows 11. It's the one Microsoft keeps nudging users toward with system tray icons and browser integrations. And it's the one the company has made deliberately difficult to remove.
The terms go further than a simple accuracy warning. Microsoft disclaims all warranties on Copilot's outputs, including any guarantee that responses won't infringe copyrights, trademarks, or privacy rights. Users who publish or share AI-generated content do so entirely at their own risk. There's also a mandatory indemnification clause: users agree to hold Microsoft harmless from any claims arising from their use of the tool.
The two-mask problem
This is a pattern across the AI industry, and it's worth being blunt about it. Companies market these tools as productivity powerhouses while their legal departments quietly classify them as toys. The marketing says "your AI companion for work." The terms of service say "this is a game, don't take it seriously."
Microsoft isn't even the most brazen example. As The Register reported, Anthropic does something stranger with its Claude consumer terms. When you load the consumer terms from a European IP address, the page swaps in a section that reads: "Non-commercial use only. You agree not to use our Services for any commercial or business purposes." The European version of the terms also excludes liability for loss of profit, business interruption, or loss of business opportunity. A plan called "Pro" that you can't use professionally. The Register confirmed the discrepancy by checking from both US and European IP addresses.
For what it's worth, the standard US version of Anthropic's consumer terms limits the "non-commercial" restriction to evaluation or trial usage. The European version appears to apply it more broadly, likely as a hedge against the EU's tighter consumer protection framework. I couldn't find the exact EU-specific terms published as a separate document, so I'm relying on The Register's verification here.
Who else does this?
Pretty much everyone. xAI warns that Grok's outputs may contain hallucinations, offensive material, or inaccurate information about real people. OpenAI and Google have similar language in their respective terms. The specifics vary, but the posture is the same: helpful but not reliable, useful but not trustworthy, a tool but not one you should actually depend on.
The "entertainment purposes only" phrasing stands out because it's unusually blunt. Most companies stick to vaguer formulations about not relying on outputs for important decisions. Microsoft went with language that sounds like a disclaimer on a fortune-telling app.
Why it matters for enterprise buyers
Here's the thing. The consumer terms and the enterprise terms are different documents. Organizations paying for Microsoft 365 Copilot operate under the Microsoft Product Terms and Data Protection Addendum, which are more conventional enterprise agreements. So in theory, the "entertainment only" language doesn't apply to the $30/month business product.
But the boundaries between consumer and enterprise Copilot are blurry, and getting blurrier. Microsoft has been auto-deploying Copilot features into enterprise tenants, a practice that prompted enough admin complaints that the company paused the rollout in March 2026. Gartner even suggested that organizations ban Copilot use on Friday afternoons because fatigued employees might be too lazy to check its outputs. That recommendation, frankly, tells you everything about where we are with AI reliability.
The consumer terms also apply when employees use personal Copilot accounts for work tasks, which is a scenario most IT departments haven't fully locked down. If an employee drafts a customer email using the free Copilot sidebar in Edge, that's the consumer terms. Entertainment purposes only.
The gap nobody's closing
Courts look at contracts, not marketing decks. In a dispute, the written terms win. And right now, those terms say this technology is for fun. Companies deploying Copilot to generate code, draft contracts, or handle compliance documentation are, per Microsoft's own language, doing so at their own risk.
Microsoft has acknowledged this tension in its own way. During the London leg of its AI tour earlier this year, every Copilot demo came with verbal warnings that the tool couldn't be fully trusted and that human verification was required. The company knows. The legal team knows. The question is whether the buyers know.
The FTC hasn't weighed in on whether this kind of disconnect between marketing and terms of service constitutes a deceptive practice, and there's no indication they will. For now, the industry operates in a comfortable contradiction: sell AI as indispensable, disclaim it as entertainment.
